Terms of Service

Last updated 1 October 2026

These terms are between Niall O’Neill, trading as SectorScan (“SectorScan,” “we”), and the person or organisation using the service (“you”). By creating an account or using SectorScan, you agree to them.

Open item for legal review: SectorScan is currently a sole trader, not a limited company — confirm this entity framing, and the personal-liability implications for the clauses below, are acceptable as the founder’s exposure while pre-incorporation.

What SectorScan does

SectorScan builds targeted, verified B2B contact lists. You describe who you want to reach, SectorScan finds the organisations, works out a contact address — for free where a public email convention exists (“derive”), or by discovering and verifying one where it doesn’t (“find,” the only metered action) — and lets you export the result.

Who can use it

SectorScan is a business tool. You must be at least 18, and if you’re using it on behalf of an organisation, authorised to agree to these terms for it.

Your responsibilities

Plans & billing

Current plans: Free (free), Starter ($49/month), Growth ($199/month), Agency ($499/month), Enterprise (custom pricing). Derivation is free and unlimited on every plan; paid plans meter verifications and export rows. Subscriptions are billed monthly or yearly (yearly gets two months free) through Stripe. Prices are shown excluding tax; VAT or sales tax is added at checkout based on your location. You can upgrade, downgrade, or cancel at any time from Plans → Manage billing.

Data & compliance

How SectorScan sources and handles data is described in the Privacy Policy. Using SectorScan doesn’t make your own outreach compliant by itself — see “Your responsibilities,” above.

Intellectual property

SectorScan owns the platform, its software, and its brand. You own the lists you export and the campaign inputs you provide. We don’t claim rights over your exported data beyond what we need to provide the service.

No warranty on yield

SectorScan estimates the addressable market for a segment, but actual results depend on real data coverage, which varies by segment and grows over time. We don’t guarantee a specific number of verified contacts for any search.

Beyond that, the service is provided “as is,” without warranty of any kind, to the extent the law allows. Open item for legal review: standard SaaS as-is/no-warranty language — confirm this is sufficient or needs strengthening.

Limitation of liability

Open item for legal review — deliberately left unwritten here. This is the clause DECISIONS.md flags as the reason for a professional legal pass before anything is public: as a sole trader, Niall O’Neill’s liability is personal and currently unlimited. A solicitor should set the actual liability cap and carve-outs here, not an AI draft.

Termination

Either of us can end this agreement at any time; you by cancelling your subscription and closing your account, us by giving reasonable notice except where we reasonably believe you have broken these terms. On termination, your access ends and data is handled per the Privacy Policy’s retention section.

Governing law

These terms are governed by the law of Ireland, and any dispute is subject to the exclusive jurisdiction of the Irish courts.

Changes to these terms

We’ll update the date at the top of this page when these terms change, and give notice of material changes.
